Terms & Conditions
Effective Date: 28 August 2026
Last Updated: 21 October 2026
1. Scope and Contracting Parties
-
These Terms & Conditions (the "Terms") govern all sales contracts entered into via the online store Margaret Hale between:
-
The Seller: Bhadella Brothers LLC, 75 E 3RD ST, Sheridan, WY 82801, United States (trading as Margaret Hale; Contact: info@margarethale.co.uk).
-
The Customer: Any individual consumer purchasing goods for personal, non-commercial use.
-
-
By placing an order through our website, you confirm that you are at least 18 years of age and legally capable of entering into binding contracts under the laws of the United Kingdom.
2. Contract Formation and Order Processing
-
Invitation to Treat: The presentation and display of goods on our website do not constitute a legally binding offer by us, but rather an invitation to treat (invitatio ad offerendum).
-
Order Submission: By completing the online checkout process and clicking the button to pay for your order, you submit a binding offer to purchase the selected items.
-
Contract Conclusion: A legally binding sales contract is formed when we accept your offer, which occurs upon:
-
Direct debiting or charging of your payment method via an instant payment gateway (e.g., Shopify Payments, Credit/Debit Card, PayPal, Klarna), or
-
Issuance of an official Order Confirmation email or Dispatch Confirmation email to the address provided.
-
-
Automated Fulfillment & In-Transit Cancellations: Due to our automated logistics infrastructure, orders are transmitted to our fulfillment centers immediately upon payment verification. Once processing has begun, orders cannot be halted or modified while in transit. You retain your full statutory right to return the goods after physical receipt in accordance with Section 8 of these Terms and our Refund & Return Policy.
3. Pricing, Currency, and Import Formalities
-
Pricing & Currency: All prices displayed on our website are stated in Pound Sterling (£ / GBP) and include applicable statutory taxes.
-
Delivery Charges: Delivery is provided free of charge on all orders across the United Kingdom.
-
Direct Import & Customs: Products are dispatched directly from international central fulfillment centers. In the rare event that UK border authorities, HM Revenue & Customs (HMRC), or postal carriers levy administrative clearance charges or import fees on incoming packages, these costs remain the responsibility of the recipient.
4. Delivery, Failed Attempts, and Customer Obligations
-
Delivery Destination: We deliver exclusively to valid postal addresses located within the United Kingdom.
-
Estimated Delivery Timelines: Total fulfillment time comprises processing (1 to 3 business days) plus carrier transit (6 to 9 business days), for a total of 7 to 12 business days. While we make every effort to meet these timeframes, all delivery dates are estimates and non-binding unless explicitly agreed otherwise.
-
Duty of Acceptance: The customer is obligated to accept the delivered parcel. Refusing delivery at the doorstep or abandoning a package at a local collection depot does not constitute a valid cancellation. Return shipping costs or handling surcharges resulting from unjustified refusal of delivery may be deducted from any eligible refund.
-
Address Accuracy: The seller is not liable for delayed or failed deliveries resulting from incomplete, incorrect, or outdated shipping addresses supplied during checkout. Reshipment fees for failed deliveries caused by incorrect customer information will be charged to the customer.
5. Passing of Risk and Title
-
Risk of Loss: Under Section 29 of the UK Consumer Rights Act 2015, the risk of loss, damage, or deterioration of the goods transfers to the customer only upon physical delivery of the parcel to the customer or an authorised third party (e.g., a designated neighbor or safe place).
-
Retention of Title: All supplied goods remain the property of Bhadella Brothers LLC until full payment has been received.
6. Conformity of Goods and Statutory Rights
-
Consumer Rights Act 2015: We are legally obligated to supply goods that conform to the sales contract. Goods must be of satisfactory quality, fit for purpose, and as described.
-
Minor Commercial Variations: Minor, commercially acceptable variations in colour tone, texture, finish, or dimensions arising from display screen calibrations or manufacturing tolerances do not constitute a material defect or breach of contract, provided they do not impair the functionality or usability of the product.
-
Faulty or Damaged Goods: If an item is defective, damaged upon arrival, or fundamentally misdescribed, you are entitled to statutory remedies under UK consumer law, including repair, replacement, or a refund. Please notify our customer support team at info@margarethale.co.uk with photographic evidence within 48 hours of discovery.
7. Limitation of Liability
-
Nothing in these Terms shall limit or exclude our liability for:
-
Death or personal injury caused by our negligence;
-
Fraud or fraudulent misrepresentation;
-
Any breach of statutory terms implied by the Consumer Rights Act 2015; or
-
Any other liability that cannot be excluded or limited by applicable UK law.
-
-
To the fullest extent permitted by law, the seller shall not be liable for indirect, incidental, or consequential losses, business interruptions, loss of profit, or loss of data resulting from the use of our services or products.
8. Statutory Right of Cancellation & Returns
As a UK consumer, you have the statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your purchase within 14 days of physically receiving the goods without giving any reason.
For specific instructions, return addresses, and exceptions (e.g., unsealed hygiene items), please refer to our dedicated Refund & Return Policy.
9. Governing Law and Dispute Resolution
-
Governing Law: These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
-
Jurisdiction: Consumers resident in Scotland or Northern Ireland retain the benefit of mandatory consumer protection laws in their jurisdiction and may bring proceedings in their local courts.
-
Informal Resolution: In the event of any dispute, we encourage you to contact our customer support team first so we can resolve the issue informally and promptly.
10. Amendments to Terms
We reserve the right to revise and update these Terms periodically. The version of the Terms in effect at the time you place your order will govern your purchase.
